PKR fails to get court order for police probe on voters' transfer to Wangsa Maju
KUALA LUMPUR, May 3 (Bernama) -- The High Court here today dismissed a leave application by a voter in Wangsa Maju to compel the police to investigate the alleged massive transfer of voters in the Electoral Roll to the parliamentary constituency.
Judge Datuk Nordin Hassan dismissed the application by Taman P Ramlee PKR (in Wangsa Maju) leader S.Raveentheran after allowing a preliminary objection by senior federal counsel Shamsul Bolhassan.
Nordin made the decision in chambers after hearing submissions by both parties.
Raveentheran was represented by lawyer Lim Heng Seng.
Shamsul, who represented the Election Commission (EC) and four others named as respondents, when contacted, said the ruling by the court was made in accordance with Section 9A of the Election Act 1958 that an electoral roll could not be challenged once gazetted.
He said the court also agreed with his submission that the power of the police in conducting investigation could not be revised.
Raveentheran filed the judicial review application last April 27 for a court order to compel the police to investigate the purportedly massive transfer of voters into the Electoral Roll for the Wangsa Maju parliamentary constituency.
Besides the EC, he also named the Inspector-General of Police, Wangsa Maju District Police Chief, EC chairman and its chief registrar as respondents.
He had sought a declaration that the EC failed in carrying out its statutory responsibilities in accordance with the law.
